Partner Kumen Taylor successfully defended the firm’s client in a recent brain injury case. After a hotly contested trial, the jury returned a unanimous defense verdict in favor of Mr. Taylor and his client. The plaintiff sued the defendant asking for 1.1 million dollars in damages.

Partner Mike Wall and Associate Jeffrey Hall successfully obtained a judgment for a client in litigation concerning the purchase of commercial medical buildings. The firm’s client was initially sued for an alleged breach of the sales contract for the buildings. The firm’s attorneys successfully obtained a rescission of the sales contract for the buildings when it was found that buildings had defects.

Kistler and Hall obtained dismissal of a complaint alleging fraud and negligent misrepresentation in connection with the sale of stock in a corporation. The Plaintiffs brought suit in Reno, arguing that they were fraudulently induced by the corporation’s board of directors into purchasing shares of the company. More than $1.5 million in damages were sought against the Firm's client.

Hutchison & Steffen attorneys Kumen Taylor and Chris Orme defeated Plaintiff’s motion for summary judgment on its claim that Plaintiff fully indemnified and defended Hutchison & Steffen’s client in an underlying wrongful death lawsuit. Plaintiffs also argued that the court did not have jurisdiction over the matter since it was an issue of insurance. The court rebuffed Plaintiff’s attempt to have the court stripped of its jurisdiction by finding that the Plaintiff “ignored” the fact that Hutchison & Steffen’s client’s claims for indemnity and defense were based on the terms of the rental contract and not related to any insurance contract. On September 28, 2011, the parties involved in the federal lawsuit brought by 26 states challenging the constitutionality of the Patient Protection and Affordable Care Act filed their formal requests (known as writs of certiorari) with the U.S. Supreme Court to review the 11th Circuit Court of Appeal's decision concerning the law.
